He filed a <a href="http://www.gillettenewsrecord.com/articles/2007/11/04/news/news07.txt">premises liability lawsuit</a> against the company in court last week. His lawyer argues that he reinjured a knee that has been operated on previously. </p><p><blockquote>Dick Baker was shopping at the store Feb. 20, 2005, when the accident happened. He walked around the end of an aisle, stepped into a pool of water caused by a leaking roof and fell, according to court documents. The spot was not marked off with warning signs.</blockquote></p><p>The fall caused the man nerve damage and chronic pain. The lawsuit is asking for an unnamed amount of damages.
